These Terms of Use ("Terms") apply to your use of eliteofia.com, including our campaign page at eliteofia.com/tv (the "Site"). The Site is operated by Elite Restoration Services of Iowa, LLC ("Elite," "we," "us," or "our"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. These Terms Cover the Website Only

These Terms apply only to your use of the Site. They are not a contract for mitigation, restoration, or repair services. Submitting an inspection request does not create a contract for services and does not guarantee that we can schedule a visit at a particular time.

Any work we do is governed only by the written work authorization or contract you sign with us for that job. If anything in these Terms conflicts with a signed work authorization, the signed work authorization controls.

2. Free Inspections

We offer free on-site inspections for properties within our service area in the Des Moines metro and Central Iowa; ask us about any limits when you call. A free inspection means there is no charge for us to visit, look at the damage, take moisture readings and photos, and explain your options. Mitigation, cleaning, lab testing, repairs, and other work are not included in the free inspection and are charged only if you approve them in a signed work authorization. We may decline or reschedule inspection requests outside our service area or when it is not safe to enter the property.

3. No Guarantee of Insurance Coverage

Elite is not an insurance company, insurance agent, or public adjuster. We cannot promise that your insurance will cover any loss, inspection, or work. Only your insurance company decides what your policy covers and how much it will pay. You are responsible for your insurance deductible and for any amounts your insurance does not pay, as explained in your signed work authorization. We do not waive, rebate, or pay insurance deductibles. We do not negotiate insurance claims on your behalf. If you ask us to, we can provide documentation of the damage and our work to you or to your insurance company.

4. General Information Only

The content on the Site, including articles, tips, checklists, photos, and descriptions of our services, is general information. It is not professional engineering, environmental, medical, insurance, or legal advice, and it is not a substitute for an on-site inspection. Every property and every loss is different. If you have health concerns about water damage, mold, smoke, or soot, talk to a medical professional. For questions about your insurance policy, talk to your insurance company or agent. For legal questions, talk to a lawyer.

If you have an emergency such as a fire, gas leak, or electrical hazard, call 911 first.

5. Affiliated Business

The Site mentions M&B Contractor Services LLC, a repair and reconstruction contractor owned by the same people who own Elite. Using M&B is optional. You are free to use any contractor you choose, and choosing another contractor will not affect the mitigation services we provide to you.

6. Our Content and Intellectual Property

The Site and its content, including text, graphics, logos, photos, videos, and the "Elite Restoration" name, are owned by Elite or used with permission and are protected by copyright, trademark, and other laws. You may view and print pages from the Site for your personal, non-commercial use. You may not copy, reproduce, modify, distribute, or use our content or trademarks for any other purpose without our written permission.

7. Acceptable Use

When using the Site, you agree not to:

  • Submit false, misleading, or someone else's information, or submit requests on behalf of someone without their permission
  • Use the Site for any unlawful purpose
  • Send spam, automated submissions, or harmful code such as viruses
  • Try to gain unauthorized access to the Site, its servers, or any connected system
  • Interfere with the Site's operation or security
  • Copy or "scrape" the Site's content using automated tools
  • Use the Site to harass, threaten, or harm anyone

We may block access to the Site or ignore submissions that violate these Terms.

8. Your Submissions

When you send us information through the Site, you confirm that it is accurate and that you have the right to share it. Our Privacy Policy explains how we use and protect that information. We work to keep the Site accurate and up to date, but we do not promise that it is complete, current, or error-free, or that it will always be available. THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT ALLOWED BY LAW. Any warranty for our services is provided only in your signed work authorization.

11. Limitation of Liability

TO THE FULLEST EXTENT ALLOWED BY LAW, ELITE AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE OR ITS CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE WILL NOT BE MORE THAN ONE HUNDRED DOLLARS ($100).

This section applies only to your use of the Site. It does not limit our responsibilities under a signed work authorization, and it does not limit any liability that cannot be limited under applicable law.

12. Indemnity

If you misuse the Site or violate these Terms, you agree to be responsible for, and to reimburse Elite for, any claims, losses, and reasonable costs (including reasonable attorney fees) that result, to the extent allowed by law.

13. Governing Law and Where Disputes Are Decided

These Terms are governed by the laws of the State of Iowa, without regard to its conflict-of-law rules. Any dispute arising out of or related to these Terms or your use of the Site will be decided only in the state courts located in Polk County, Iowa, or the United States District Court for the Southern District of Iowa, and you and Elite agree to the jurisdiction of those courts. Disputes about work we perform are governed by your signed work authorization.

14. Other Terms

If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any part of these Terms is not a waiver. These Terms, together with our Privacy Policy, are the entire agreement between you and Elite about your use of the Site.

15. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page and change the effective date at the top. Your continued use of the Site after changes are posted means you accept the updated Terms.

If you need repairs or rebuilding after mitigation, M&B is one option, but you are never required to use M&B.
